CEER Legal Training on Evolving Regulatory Processes in European Energy Policy

13-14 February 2017, Brussels

Course Organisation

The EU’s Electricity and Gas Directives and related legislation, adopted in 2009 and collectively known as the “3rd Package”, introduced a new set of rules relating to the organisation and functioning of the European electricity and gas sectors. The energy regulatory processes have been and will continue to evolve with the European Commission's new proposals on "Clean Energy for All Europeans". One of the aims of the new legislative proposals is to set the governance rules for the Energy Union. How have the regulatory processes evolved in recent years? What is proposed in the European Commission's new legislative proposals and what might they change?

This CEER Legal Training will address these evolving regulatory processes in European energy policy and how they affect the work and cooperation of National Regulatory Authorities.

Designed for:

Level B: Specialised Course

Legal experts from National Regulatory Authorities (NRAs) with legal background and previous experience in energy regulatory framework and Network Codes/Guidelines (at least 2-3 years experience). Other non-legal experts with previous experience in these topics from NRAs and European Institutions (ACER, European Commission) are also invited to attend.

Programme overview:

  • Review the governance framework and recent development of governance rules with regard to the functioning of the Agency for the Cooperation of Energy Regulators (ACER) and cooperation of NRAs within ACER and exchange experience on governance rules set out in other EU Agencies
  • Discuss the rules and principles setting out the regulators' independence and the assessment of how different principles are interpreted and applied in practice
  • Explore how NRAs deal with one of the most important regulatory challenges introduced by the Network Codes and Guidelines - decisions on cross-border issues and assessment of the arrangements for cross-border decisions
  • Examine the challenges of the implementation of Network Codes and Guidelines and exchange views and experiences with various stakeholders
  • Discuss the judicial review of regulatory decisions taken on the basis of Network Codes and Guidelines
  • Exchange experience on the legal challenges and participate in exciting discussions on the ongoing case studies of electricity and gas network codes and cross-border decisions

Scholarships

CEER offers two scholarships of 50% fee reduction to two participants from CEER members and observers for attending this course. The scholarships are offered based on the principle of helping those facing budget constraints to reduce the costs of sending their staff to CEER training courses.

The eligible NRAs for CEER Training Scholarships are those from countries whose GDP per capita falls below the 90% threshold of the EU-28's GDP per capita (according to the Eurostat official data: http://ec.europa.eu/eurostat/tgm/table.do?tab=table&init=1&plugin=1&pcode=tec00114&language=en).

Participants from the qualified NRAs are invited to apply for the two CEER Training Scholarships for this course by indicating this in the online registration form in the tab "Registration". When the registration is closed, the two selected participants will be notified whether they get the scholarships. If more than two individuals apply for the scholarships, only two participants from the qualifed NRAs with the lowest percentage from the Eurostat figures are chosen.
