Record-keeping, transparency and exchange of information – ERGEG and CESR advice to the European Commission in the context of the Third Energy Package

Following the European Commission’s request for advice, ERGEG and CESR have conducted a public consultation on record-keeping, transparency and exchange of information. The ERGEG and CESR joint advice has been delivered to the European Commission.

Market Abuse – ERGEG and CESR advice to the European Commission in the context of the Third Energy Package – Response to Question F.20

Following the European Commission’s request for advice, ERGEG and CESR have conducted a public consultation on market abuse issues related to energy trading.
The ERGEG and CESR advice addresses the questions raised in the Commission’s mandate regarding the scope of Directive 2003/6/EC on insider dealing and market manipulation (market abuse) and whether it properly addresses market integrity issues in the electricity and gas markets; whether greater transparency obligations would impact on this assessment and the regulators suggestions to mitigate any shortcomings.
The ERGEG and CESR joint advice has been delivered to the European Commission.

ERGEG and CESR fact-finding results on pre- and post-trade transparency and trading oversight

Following the European Commission's request for advice, ERGEG and CESR have conducted a fact-finding exercise on the current situation in the EU Member States with regard to pre- and post-trade transparency and trading oversight on the basis of a questionnaire circulated to their members. The results of the fact-finding exercise have been sent to the European Commission.

The Green Package – Proposed EU ETS and Renewables Directives: A CEER Position Paper

The CEER shares the EU concerns on climate change and recognises the need to take immediate action in this area. As such, regulators welcome the EU’s “Climate action and renewable energy package” (Green Package) which will facilitate the achievement of binding targets on greenhouse gas emissions (GHG) to which all Member States have committed and where renewable energy has a key role to play. This paper sets out a few areas where regulators feel the mechanisms for delivering the targets need refinement to reflect the particular circumstances of the energy sector, and proposes ideas for how this can be achieved.

Strategic guidelines and codes

28th April 2008, ERGEG publishes examples of their suggested alternative approach to the process for adoption of EU codes and rules as foreseen in the 3rd energy liberalisation package. This approach entails the development of strategic guidelines through comitology and the adoption of technical codes by the Agency.

These examples are not definitive, however, they are useful to explain how the regulators’ approach to the development of codes and rules will work in practice and, most importantly, how the Strategic Guidelines that we expect will be agreed by the Commission, will be developed.

The examples illustrate the difference between the areas involving substantive discretion (and therefore must be dealt with through a comitology process) and those issues which include technical details and therefore could be dealt with in technical codes to be prepared by ENTSO and approved by the Agency.
