Target Organisation and REMIT Implementation at National Level (2025)
Contributing to the implementation of Regulation on Wholesale Market Integrity and Transparency (REMIT) was identified as a key focus of the Council of European Energy Regulators (CEER), in particular where REMIT provides a formal role for National Regulatory Authorities (NRAs). This priority has become even more significant with the further strengthening of the regulatory framework following the entry into force of the revised REMIT on 7 May 2024[1] (REMIT II).
In this context, a survey was conducted among NRAs in 2025 to update and assess the REMIT organisation and implementation within NRAs at national level, in order to have a comparison between them and to identify changes made since the entry into the force of revised REMIT. Responses to the survey were received from 27 NRAs (25 CEER members from the European Union/EEA[2], 1 CEER member outside European Union and 1 CEER observer outside European Union).
The CEER questionnaire focused on organisational and human resources aspects to identify best practices among NRAs at the EU level for REMIT implementation. It explored how NRAs structure internal tasks related to REMIT obligations (including the number and background of staff involved) recognising that the resources allocated to these tasks may vary across Member States.
Main findings
NRAs across Europe are further strengthening their monitoring of wholesale energy markets in line with the revised REMIT. These enhanced efforts aim to protect consumers, uphold market integrity, and ensure transparent trading practices during the ongoing energy transition.
- Dedicated Teams: Regulators have multidisciplinary teams of economists, engineers, lawyers, and analysts for ensuring rigorous supervision of wholesale markets.
- Focus on Market Integrity: Resources are dedicated to the detection and prevention of market misbehaviour, with procedures in place to investigate suspicious activities, including the ability to launch cross-border investigations as needed.
- Consumer Protection: Monitoring activities protect households and businesses against unfair practices, contributing to stable and reliable energy prices.
- Cooperation Across Borders: Regulators collaborate continuously among themselves and with ACER as well as with energy exchanges, financial authorities, national competition authorities, and other relevant parties reinforcing trust and resilience across European energy markets.
- Legal and Enforcement Capacity: Most NRAs have all necessary powers to tackle breaches of REMIT provisions and apply sanctions aligned with European standards, and for those that have not yet fully implemented these capabilities, the remaining steps are expected to be completed soon.
- Technology and Innovation: Regulators are enhancing their IT capabilities and alert systems, emphasizing publicly available market information and exchange trading data, to ensure decisions are based on the most complete view and the most relevant signals, and to further improve market surveillance, including continuous effort to adopt advanced tools to detect complex trading patterns.
By finetuning monitoring tools, improving the internal organisation, strengthening cooperation, and reinforcing enforcement powers, NRAs are ensuring that Europe’s energy markets remain fair, competitive, transparent, liquid and resilient. Ongoing market surveillance protects households and businesses against unfair trading practices on wholesale energy markets, contributing to stable and reliable energy prices.
